Fees/ Payment Terms
If at some point you pay to use our Website, you represent and warrant that when you make any payments to Destination2Travel for such use:
- You agree to pay the fees at our then-current prices as posted on our website, including any applicable taxes
- You agree to provide true and complete credit information;
- You agree that fee will be honored by your bank or credit card company; AND
- You agree that if your initial payment method is dishonored, you will still pay the charges incurred, including any surcharge we may incur due to such dishonored payment.
All purchases and reservations made on Destination2Travel are final and non-refundable. In the event of a cancellation or request for modification of the reservation, Destination2Travel and the service suppliers are not obliged to honor such requests and the entire amount paid is forfeited by the customer.
Refunds, if any, are provided at the sole discretion of Destination2Travel and the service suppliers.
The User understands and agrees that any of the services provided by Destination2Travel shall commence on payment of fees for the services. Destination2Travel shall be entitled to terminate the services furnished to the User in case of non-payment or delay or payment.
Use of Information
We reserve the right, and you authorize us, to the use and assignment of all of your Profile information and usage information regarding our Website in any manner consistent with our Privacy Policy. You acknowledge that if you violate the terms of our Legal Terms, Destination2Travel reserves the right to terminate your account without notice. You may also voluntarily terminate your account. You understand that if your account is terminated, you will lose access to our Website and any Member Content you have provided. You understand that we are not required to provide you with copies of such Member Content nor continue to maintain copies of such Member Content on our Website.
Arbitration
Any legal controversy or legal claim arising out of or relating to our Legal Terms and/or our Website, excluding legal action taken by us to collect or recover damages for, or obtain any injunction relating to intellectual property infringement, shall be settled solely by binding arbitration in accordance with the Indian Council of Arbitration (ICA) or Commercial Arbitration Rules of the American Arbitration Association depending on the product sale by any of the Destination2Travel offices.
Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted before an arbitrator selected by Indian Council of Arbitration(ICA) or the American Arbitration Association in Delaware, USA depending on the product sale to any of the Destination2Travel offices / companies The judgement of such arbitrator on award may be entered into any court having jurisdiction thereof.
We may seek any interim or preliminary relief from a court of competent jurisdiction within Jaipur India or state and federal courts of the State of Delaware as necessary to protect the rights or property of you and us pending the completion of arbitration. Each party shall bear one-half of the arbitration fees and costs, but the prevailing party may seek return of such arbitration fees and reasonable attorney fees.
Promotions
Destination2Travel and its partners may, from time to time, choose to run certain marketing promotions. These promotions may be made available to some or all customers at the discretion of the company.
Promotion Code: If you have a valid promotion code, you may use this during checkout to avail the necessary offer. The promotion discount, if applicable, will be deducted directly from your final price payable. Promotions are governed by the terms and conditions of individual offers and Destination2Travel reserves the right to cancel any orders that are found to be violating these terms. Customers who repeatedly abuse promotion terms may, at the discretion of the company, find their accounts blocked and they will be unable to reserve on the Destination2Travel platform any further.
Destination2Travel Credits can be earned on completing eligible purchases, successfully referring a new customer or completing other eligible activity for earning such credits as determined by Destination2Travel. Destination2Travel Credits can be applied to any future reservation up to the full amount of the order. Destination2Travel Credits cannot be paid out in cash or used to pay for an existing reservation.
If a customer cancels the original reservation they received credits for, the associated Destination2TravelCredits will be reversed as well. Destination2TravelCredits automatically expire in a certain duration as stated when provided after they are credited to your account. No refund is provided for any expired or unused credits.
General Terms
Destination2Travel consists of M/S Destination2Travel based out of India.
The terms of Indian identity shall be treated as though they were executed and performed by Indian laws, the jurisdiction will be based out of Jammu, Jammu & Kashmir, India. The Legal Terms shall be governed by and construed in accordance with the laws of India.
To the extent that any Content in our Website conflicts or is inconsistent with our Legal Terms, our Legal Terms shall take precedence. Our failure to enforce any provision of our Legal Terms shall not be deemed a waiver of such provision nor of the right to enforce such provision. The rights of Destination2Travel under our Legal Terms shall survive the termination of our Legal Terms.
